1. Introduction 

1.1. These terms and conditions (the "Terms and Conditions") govern the use of www.discovermonk.com (the "Site"). This Site is owned and operated by Monk Global Limited. By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
1.2. ‘Business Day’ means a day other than a Saturday, Sunday or public holiday when banks in London are open for business.
1.3. ‘Event Outside Our Control’ has the meaning given in clause 17.
1.4. ‘Goods’ means the goods listed on our website and apps (together ‘the Site’) which we may supply, including but not limited to the Monk ice baths, chillers, accessories and spare parts. 
1.5. Before confirming your order please read through these Conditions, as well as our cancellations and refund policy and limitation of our liability and your indemnity at clause 15.
1.6. By ordering any of the Goods, you agree to be legally bound by these Conditions. You will be unable to proceed with your transaction if you do not accept these terms and conditions.
1.7 All content published and made available on our Site is the property of Monk Global Limited and the Site’s creators. This includes, but is not limited to, images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

2. About us

2.1. We, Monk Global Limited, own and operate this Site. We’re a limited company registered in England and Wales under company number: 13332872. Our registered office is at 71-75 Shelton Street, London WC2H 9JQ. Our VAT Number is 399820243.
2.2. Our email address is support@discovermonk.com. 

3. Eligibility to purchase from the Site

3.1. To be eligible to purchase the Goods and lawfully enter into and form a contract with us, you must be 18 years of age or over.

4. Price

4.1. The prices of the Goods are quoted on the order page.
4.2 Prices and any other charges shown on the order page are based on delivery to the United Kingdom or the European Union, unless otherwise specified.
4.3 Delivery costs are calculated at checkout and depend on destination, weight, and service level.
4.4 Unless otherwise stated, prices include UK VAT for deliveries within the UK. For deliveries outside the UK, taxes may be collected locally (see Clause 9.7).

5. Payment

5.1. Payment can be made by any major credit or debit card or through the consumer financing options that we may offer on our Site.
5.2. By placing an order, you consent to payment being charged to your debit/credit card account as provided on the order form.
5.3. If you pay us by credit or debit card we will take payment from your card for the Goods before we dispatch the Goods to you or make the Goods otherwise available to you.
5.4. We shall contact you should any problems occur with the authorisation of your card.

6. Interest

6.1. Unless clause 6.2 applies, you must pay us interest on any amounts you owe us and fail to pay us on the due date at the rate of 3% a year above the base lending rate of the Bank of England from time to time, accruing daily from the due date until the date of payment, whether before or after judgement.
6.2. We will not charge you interest for the period of dispute in respect of an invoice that you dispute in good faith, provided you have advised us within a reasonable time of receiving it that you dispute it and your basis for disputing it.

7. Order process and formation of a contract

7.1. Our Site, and broader media, merely illustrate our Goods and the packaging of the Goods. Your computer may not accurately display the colours of the Goods. Although we aim to accurately depict our Goods and their packaging, there may be differences between the packaging and the colours of the Goods delivered to you and those shown on our Site and in our media.
7.2. If the Goods are temporarily unavailable, we will notify you by email of the date they are expected to be available. You will have the option either to wait until they are available or to cancel your order. If you cancel your order, we will refund any sums you have paid us.
7.3. Any order placed by you for the Goods constitutes an offer to purchase them from us.
7.4. You agree that if we contact you to acknowledge receipt of your order such communication shall not amount to our acceptance of your offer to purchase the Goods.
7.5. A ‘Confirmation Notice’ means an email which we send to you to confirm that we have dispatched the Goods. A Confirmation Notice will be our acceptance of the offer made in the order to which that Confirmation Notice relates.
7.6. A contract between you and us for the supply of the Goods (the ‘Contract’) incorporating the version of these Conditions in force at the time of your order will come into existence when we send you the Confirmation Notice relating to your order. You may print and keep a copy of the Confirmation Notice for future reference.
7.7. If you think that there is a mistake in the Confirmation Notice or if you wish to make any changes, please contact us to discuss this. If you request a change, we will tell you if that is possible and about any changes to the price, delivery or performance dates or any other changes that we need to make as a result of your request. We will ask you if you wish to go ahead with the change.
7.8. We may make:

7.8.1. minor technical adjustments to the Goods to improve them or to comply with relevant laws and regulatory requirements, 
7.8.2. changes to these Conditions as a result of changes in any relevant laws and regulatory requirements,
7.8.3. changes to these Conditions as a result of changes in how we accept payment from you,
7.8.4. changes in the amount payable by you to the extent of any changes in the VAT included in the price or payable in relation to the price. 

8. Pre-sale

From time to time, Monk may offer pre-sale access to new products.

8.1 Availability: Pre-ordered items are sold on a first come, first served basis, and are limited by quantity.
8.2 Product subject to change: The photos and media shown are of prototypes or digitally generated images, and are a visual representation of the product. While we endeavour to change as little as possible, the final product is subject to change.
8.3 Statutory cancellation rights apply to delivered goods in accordance with our Returns & Refund Policy.

9. Delivery

9.1 Delivery Address: The Goods will be delivered to the address you provided during the order process, which may be different from the billing address.
9.2 Delivery scope: We currently deliver to addresses in the UK and EU. Any country-specific limitations are shown at checkout and in our Returns & Refund Policy. Monk Origin is available for delivery to the UK only. Goods that you subsequently ship outside your delivery country are not eligible for return or warranty service.
9.3 Delivery fees are shown at checkout and vary by destination and weight. For international orders, delivery timeframes are estimates and may be impacted by customs. For Monk Origin orders, delivery includes positioning and removal of packaging.
9.4 Monk Origin Deliveries

Due to the size and weight of Monk Origin, deliveries require additional steps. Upgraded delivery options, such as timed deliveries, must be added at checkout.

  • Pre-Delivery Form (Monk Origin orders only): A form will be sent to gather key information around your delivery. It’s imperative that you let us know of any complexities around your delivery – we can overcome most obstacles with specialist equipment, but only if our team is prepared in advance. For particularly complicated deliveries, on-site surveys, extra delivery personnel, and additional time may be required, which will be chargeable. We'll discuss this after receiving the pre-delivery form.

  • Delivery Days: Monday to Friday, 9am-5pm as standard.

  • Scheduling Delivery: After checkout, we will contact you to schedule a suitable delivery day.

9.5 Upgraded Delivery Options (UK only):

Timed delivery (Monk Origin only): Pre 1pm / Post 1pm delivery is available at an additional £60 charge at checkout. 9am delivery is available at an additional £120 charge at checkout

Next day delivery (Not available for Monk Origin): Next day delivery may be offered in some locations. Orders with next day delivery that are placed before 4pm will be delivered the following day. Orders placed after this cutoff may be delivered one business day later. 

9.6 Pre Ordered Products

9.6.1 Pre-Ordered Products: We aim to ship pre-ordered products in accordance with the dates shown on our website at the time of purchase. We endeavour to ship the product as soon as reasonably possible, but Monk does not guarantee that it will be able to ship the product by the estimated date. As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, Monk is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms and Conditions, to provide any discounts, refunds, or credits due to any such delays.

You will be kept informed on a regular basis and will be contacted prior to the ship date.

9.7 EU Customs & Duties (DDU)

For EU deliveries, orders ship from the UK on a DDU basis: local import VAT and duties are payable by you on delivery and are collected by the courier or customs authority. These charges are separate from our delivery fees and are not refundable by Monk. See our Returns & Refund Policy for how this affects returns.

10. Risk and title

10.1. The Goods will be at your risk from the time of delivery.
10.2. Ownership of the Goods will only pass to you when we receive full payment of all sums due in respect of them including VAT or any applicable sales or local taxes and the cost of delivery.

11. Cancellations & Returns

11.1 Your statutory cancellation rights and our returns process are set out in our Returns & Refund Policy, which forms part of these Terms.
11.2 For EU customers, online purchases include a 14-day right of withdrawal. Conditions, timelines, who pays return shipping, and refund details are as stated in the Returns & Refund Policy.
11.3 If there is any inconsistency between these Terms and the Returns & Refund Policy, the Returns & Refund Policy prevails for cancellations and returns.
11.4 Promotional Guarantees (Monk Transformation Promise)

From time to time we may offer a promotional Monk Transformation Promise (e.g., 30- or 60-day money-back guarantee). This is a promotional guarantee and does not replace your statutory rights or our Returns & Refund Policy. Eligibility, territories, and conditions apply as set out below. Available only while advertised at purchase.


11.4.1 The Monk Transformation Promise (30-day policy):

If you don’t feel like a new person after 30 days of using your Monk product, we’ll provide a full refund under the following conditions:

  • Customers must complete at least 15 plunges within the first 30 days of receiving their product.

  • All plunges must be logged in the Monk App as proof of use.

  • Customers must notify us within 30 days of delivery to request a refund under the Monk Transformation Promise.

  • Transformation will be determined through both qualitative and quantitative data within the Monk app. Lack of data may result in failure to meet the 30 Day Transformation Guarantee terms.

  • The product must be returned in its original packaging and in good condition.

  • Customers are responsible for return shipping costs unless the item is defective or damaged. Monk can arrange the return, and the cost of return shipping will be deducted from the refund if applicable.

  • This offer is available in the UK only.

11.4.2 The Monk Transformation Promise (60-day policy):

Exclusive offer: If you don’t feel like a new person after 60 days of using your Monk product, we’ll provide a full refund under the following conditions:

  • Customers must complete at least 30 plunges within the first 60 days of receiving their product.

  • All plunges must be logged in the Monk App as proof of use.

  • Customers must notify us within 60 days of delivery to request a refund under the Monk Transformation Promise.

  • Transformation will be determined through both qualitative and quantitative data within the Monk app. Lack of data may result in failure to meet the 60 Day Transformation Guarantee terms.

  • The product must be returned in its original packaging and in good condition.

  • Customers are responsible for return shipping costs unless the item is defective or damaged. Monk can arrange the return, and the cost of return shipping will be deducted from the refund if applicable.

  • This offer is available in the UK only.

12. Return of Goods 

Our top priority is to fix any problems we can, either over the telephone or in-person with a Monk engineer. Any defective or damaged item that we can’t fix will be repaired or replaced. Please review our Returns Policy before making a purchase.

13. Warranty

13.1 Monk provides product-specific warranties. Summary: Monk Shiver (24 months); Monk Origin (12 months); Monk Nomad (12 months). Full terms and how to claim are set out in our Warranty Policies
13.2. EU consumers: Your statutory guarantee under EU consumer law (minimum two years covering lack of conformity present at delivery) applies in addition to any commercial warranty.
13.3. Repairs/Replacements: Monk may use refurbished replacement units that are inspected, sanitised and tested to “as new” performance. Any repair or replacement does not reset the original warranty period.
13.4. Assessment: We may require reasonable photo/video evidence to assess a claim remotely. Failure to provide such evidence may delay or prevent us from processing a claim.

14. Complaints

14.1 Complaints; Dispute Resolution: If you have a comment, concern or complaint about any Goods you have purchased from us, please raise a ticket on our website or contact support@discovermonk.com.
14.2 US customers - Arbitration: For US customers only, certain disputes may be resolved by binding arbitration under AAA rules as set out below. By using our products and services, you agree to resolve qualifying disputes through individual (non-class) arbitration in the United States. Details are provided at checkout and in your order confirmation.
14.3 UK/EU consumers - Court access & statutory rights: For UK/EU consumers, nothing in these Terms limits your statutory rights or your ability to bring claims before the competent courts of your country of residence. Any mandatory consumer protections under local law apply.
14.4 Exceptions: Small claims that qualify for small-claims court; and claims relating to intellectual property rights.

15. Liability and indemnity

15.1. We have a duty to supply Goods to you that conform to the Contract including a duty to ensure that
15.1.1. the Goods are as described in the contract
15.1.2. the Goods correspond to any samples we have sent you
15.1.3. the Goods are fit for any purpose you specifically told us they were required for, and are not faulty
15.2. We cannot exclude our liability for a failure to comply with these duties mentioned in this sub-clause. Nothing in these Conditions affects your legal rights if these duties are not complied with. You can obtain advice about your legal rights from Citizens Advice or equivalent advisors if you need to.
15.3. We cannot exclude or limit our responsibility to you for:

15.3.1. Death or personal injury resulting from our negligence or the negligence of our employees 
15.3.2. Fraud or fraudulent misrepresentation
15.3.3. A claim for a defective product against us if we do not give you the name of the person who supplied the product to us within a reasonable time of your request for us to do so.

15.4. We are responsible for foreseeable loss or damage which you suffer as a result of a breach by us of the Contract or as a result of our failure to act with reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process. We are not responsible for unforeseeable losses. 
15.5. You are purchasing the Goods as a consumer. If you purchase the Goods for any business purpose including for resale, we will not be liable for any business losses, loss of profits, loss of contracts, loss of business opportunities, loss of management time, loss of business data or losses due to interruption of your business.
15.6. We will not be responsible for any delay in delivering the Goods if 

15.6.1. we have asked you to provide specified information that is necessary for delivering the Goods and
15.6.2. you have failed to provide complete and accurate information or you have provided such information later than the date we have asked you to supply it by. 

15.7. We will not accept liability for any damage caused by pre-existing defects in any fittings, walls, pipes, wiring, gas installations in your premises or to any goods to which we connect or install or attach the Goods unless we have been negligent in not realising that such damage may occur or in the way we did the work.

16. Our rights of termination

16.1. We reserve the right to terminate the Contract by writing to you if you fail to make any payment to us when due and you still do not make payment within 14 days of us reminding you that payment is due.

17. Events outside our control

17.1. Except for our obligations under this clause, we shall not be responsible for delays or failures in delivery or performance of our obligations to you resulting from any act, event, omission, failure or accident outside our reasonable control (‘Event Outside Our Control’).
17.2. We will take all reasonable steps to minimise a delay in performing our obligations to you which arises from an Event Outside Our Control.
17.3. We will promptly notify you of any Event Outside Our Control which prevents us from or delays us in performing our obligations to you, giving details of it and (where possible) the extent and likely duration of any delay.
17.4. Our performance will be deemed to be suspended for the period that the Event Outside Our Control continues.
17.5. You may end the Contract after we have notified you of an Event Outside Our Control and we will then refund you any money you have paid to us under the Contract for the Goods which we have been unable to deliver to you. 

18. Use of personal data

18.1. We envisage that we will request personal information from you whilst you use our Site. This information will only be requested and processed in accordance with our Privacy Policy, which can be found at www.discovermonk.com.
18.2. In brief, we will act fairly in connection with personal information requested from you, when we request information we will alert you to our Privacy Policy, and unless the information is necessary for a reason specified in the General Data Protection Regulation (GDPR) we will only process it with your consent. Before receiving your information we’ll endeavour to provide the information required by the GDPR.

19. Third party rights

19.1. Except for our affiliates, directors, employees or representatives, a person who is not a party to the Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

20. Other important terms

20.1. We reserve the right to change the domain address of this Site and any services, products, product prices, product specifications and availability at any time. 
20.2. Every effort is made to keep information regarding stock availability on the Site up to date. However, we do not guarantee that this is the case, or that stock will always be available
20.3. If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of the Contract and the remainder of the provision in question will not be affected. 

21. Limitation of Liability

21.1 Monk Global Limited and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

22. Indemnity

22.1 Except where prohibited by law, by using this Site you indemnify and hold harmless Monk Global Limited and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

23. Applicable Law

23.1 UK/EU customers: governed by the laws and courts of your country of residence, and any mandatory consumer protections apply.
23.2 For customers in the US: we operate our services in compliance with all applicable U.S. laws and regulations, including but not limited to the Federal Trade Commission (FTC) Act, which governs advertising practices, consumer protection laws, and regulations around fair competition.
Additionally, we comply with the U.S. laws governing e-commerce transactions, such as the Electronic Signatures in Global and National Commerce Act (E-SIGN), and regulations related to consumer privacy and online sales.
23.3 State-Specific Laws: Certain U.S. states have unique consumer protection laws. If you are a resident of California, the following provisions apply:
California Consumer Legal Remedies Act (CLRA): Under the CLRA, California residents may have additional rights related to unfair or deceptive business practices.
California Cooling-Off Period: If you made a purchase at a location other than our main office or through a remote sale, you have three business days to cancel your transaction without penalty.
Residents of other states may have different rights based on their local consumer protection laws.

24. Severability

24.1 If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

25. Changes

25.1 These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

26. Commercial usage

26.1 Commercial Terms: For commercial purchases we require contact to partnerships@discovermonk.com. If Monk/s are purchased for commercial use directly via the Monk online store, the commercial purchaser agrees to our Commercial Terms & Conditions.
26.2 Commercial financing

26.2.1 Application & Eligibility: Financing is available to registered commercial businesses, subject to approval. The applicant must provide business details, financial statements, and relevant credit history. Approval is at the discretion of the financing partner (Tower Leasing Ltd) and is based on creditworthiness, business stability, and other risk factors.
26.2.2  Loan Structure & Repayment

    • Loan Amount: Financing is available for up to 100% of the equipment cost, subject to approval.
    • Repayment Terms: Monthly instalments over an agreed term (between 12 months to 4 years)
    • Rates: Fixed or variable rates depending on credit profile and market conditions.
    • Early Repayment: Option to repay early. No prepayment penalty charged. 

26.2.3 Fees & Charges

    • Origination Fee: A one-time setup fee of £150+VAT is applicable.
    • Late Payment Fee: Additional charges may be incurred for missed or delayed payments.

26.2.4 Ownership & Liability

    • Ownership of the equipment remains with the financing provider (for leasing agreements) until the final payment is made and a £100 ownership transfer fee is charged at the end of the financial leasing period.
    • The business is responsible for insurance, maintenance, and compliance with operational regulations.

26.2.5 Default & Termination

    • Failure to make payments may result in repossession of the financed equipment.
    • Defaulting businesses may face additional penalties, legal action, or credit score impacts.

27. Product Discounts

27.1 Veteran Discount Terms & Conditions: The Monk Veteran Discount provides a £300 reduction on the total purchase price of a Monk Smart Ice Bath. This offer is available exclusively to verified veterans and active military personnel. Verification of veteran status must be completed through Monk's verification system.

  • The discount code is non-transferable and may only be used once per eligible customer.

  • This offer cannot be combined with any other promotions, discounts, or offers.

  • Monk reserves the right to modify or discontinue this discount at any time without prior notice.

  • The discount is applicable only to purchases made directly through the official Monk website.

  • Standard return and warranty policies apply to all purchases made with the veteran discount.

  • Any fraudulent attempts to claim this discount may result in order cancellation and potential legal action.
